17 Other States Rejected In-State Tuition for Illegals - For Good Reason. Six states that do favor illegals may owe more than they bargained for, according to Federal law.

Excerpts from two articles with links:

“On May 20, [04] Kansas's Democrat Governor Kathleen Sebelius signed into law a statute giving in-state tuition at Kansas universities to illegal aliens. Similar bills were introduced in seventeen other states. Fortunately, those states had the good sense to reject the proposal. … Kansas and the six other states have openly and flagrantly disregarded federal law. “Breaking the Law, Breaking the Budget” by Kris W. Excerpts from 2nd Article
“If you are an out-of-state student attending any public postsecondary school in one of those states [who is waiving out of state tuition for illegal aliens] and are paying the higher tuition rates, you may be entitled to a refund.”

According to Federal law, if a state offers discounted, "in-state" postsecondary tuition aid to foreign nationals illegally residing in the United States, it is prohibited from charging any out-of-state student higher out-of-state tuition rates. The state and its public institutions must offer the same aid to all legal U.S. residents regardless of residency.
However, in violation of this federal law, some states currently give tuition breaks to illegal aliens, but charge American citizens from other states higher tuition fees.

If you are an out-of-state student attending any public postsecondary school in one of those states and are paying the higher tuition rates, you may be entitled to a refund.

Please send us an email with your name, telephone number, the school you attend, the difference between out-of-state tuition fees and in-state tuition fees per unit, and the amount that you feel you've been overcharged. “Instate Tuition for Illegal Aliens”
