What is the difference between a personal injury trial lawyer and a catfish?

Well, you see one is a slippery, slimey, mud-sucking bottom-feeder, and the other one is a fish!

If you think that little joke about personal injury trial lawyers is bad, you should read the article on the Arkansas Family Coalition blogspot about personal injury trial lawyer Chuck Banks! Banks has garnered large campaign donations and seems to be running for something, maybe Lt. Governor, on the Republican ticket.

AFC blog notes that Banks brags on his own site about all of the large settlements he has won from suing individuals and businesses. They also comment....

"By the way, we did a little digging in the last twenty years worth of FEC reports, and we found that for more than a few of Banks's contributors, there is no record of them ever giving to anyone but a democrat.......
....... Why is the democrat-leaning legal community so behind you, Mr. Banks? Do these folks view you as an "acceptable" candidate and are hedging their bets in the event that the other trial lawyer, Mike Hathorn, doesn't make it to the general election?"

The posters on the site don't let up either. One notes that Bank's contributions tend to come in $1,000 chunks. Another says something like........

"Vote Johnny Cochran for Lt. Governor in the GOP primary!.........What? You say he is dead. OK, how about Chuck Banks then!"

We don't know what to think of all this, except that we will monitor the story for you. I suppose if uber-liberal Mike Hathorn were to win the Democratic Nomination, as many expect, then Republicans would lose an issue if they send up Banks. That would be one personal injury attorney against another.

Now is the time when I pass the hot potato to you. Tell us what you think of the story, and the implications of it.

AFC is way off on this one. There is nothing wrong with representing the little guy against big companies or insurance companies. If they file frivolous lawsuits, they should be disbarred, but our system needs good lawyers to represent both sides and we as Republicans should respect the plaintiffs who hire these attorneys. I don't care if you oppose Banks but do it for a real reason - not his occupation. That is ridiculous.

You're a faggot for defending trial lawyers. They are worthelss, growth impairing scum. You are no better for defending them.

I'm for the real conservative in the race, the only conservatice, Doug Matayo. When Banks is ready to stand up to his record, then hell will freeze over.

I agree. It is just the 95% of the lawyers that give the rest of them a bad name!

JOKE! I was joking again. To me it is not whether or not you are a lawyer, but rather WHAT KIND of lawyer you are. For me, the jury is still out (pardon the courtroom metaphor) on that issue in this case. I'd like to know more.

Seriously though, I am concerned that his financial backing comes from those who play both sides and even those who are almost exclusivley democratic contributors.

Oh, and please watch your language and name-calling, there, Matayo supporter.

Um, Mark, do you really think the gentleman using the colorful language is a Matayo supporter?

Can't you come up with real material? This blog is losing credibility.

What is wrong with representing a plaintiff. You know there are examples of Corporations or Insurance Companies making mistakes. Why is not conservative to represent those injured people? Instead of just making lawyer jokes, lets have areal discussion.

Why hasnt anyone taken any exception to the number of Republican contributors that Beebe has? Old timers that usually play both sides are picking the winner....and buying in early....

7:14 AM, August 11, 2005
Blogger Mark Moore (Moderator) said...

To hachet: unfortunately his demeanor and tone are consistent with many of the Matayo supporters on this blog over the last few months- mean and personal. I don't say that the candidate approves of these things, but that this is the way many of his supporters represent themselves on blogs like this one.

To the humor-impaired anon posts right after Hatchet........perhaps you missed the part where I got serious, which would have been hard because I started it off by saying "Seriously". Here it is again.....

"Seriously though, I am concerned that his financial backing comes from those who play both sides and even those who are almost exclusivley democratic contributors. "

So while I reported what the AFC blog said, what sends up red flags for me is not necessarily Bank's occupation, but the fact that his supporters are FAR left of where I am, or insiders who have no idealogy other than "help other insiders".

As for being a personal injury trial lawyer goes, I also noted that their are good ones and bad ones- and we don't yet know enough to say whether Chuck Banks is a noble defender of the poor and abused or if he is a John Edwards-type ambulance chaser, or something inbetween. If you have any information that could enlighten us then you know where the post button is!

more comment over at AFC on something I have wondered about...

"Banks, along with his other problems, can't answer why he isn't running for Attorney General when the party doesn't yet have a candidate there. The answer is: Money -- he can use the part-time Lt. Governor position to drum up business for his "legal practice," while the Attorney General is full-time and would prohibit his personal practice. "

Bank's resume would be a much better fit for AG, and the GOP has no candidate for that office. Is this the real reason Bank's is jumping into an already-crowded Lt. Governor's race?

why don't we care about the number of "Republican" old timers who are giving to Bebee? Obviously it is because we are not considering supporting Bebee! The inside players are not just jumping on the Banks bandwagon, they are propping it up!

If he had $100,000 from small donor grassroots support I can see them saying, "we better get on board". He doesn't. I think he has less than 110 donors. They are trying to build a band wagon, not jump on one.

7:30 AM, August 11, 2005
Anonymous Anonymous said...

Well said Mr. Moore we'll see if the band wagon building is indeed by lawyers only. By the way all the negativity about lawyers is really kind of stupid mindless banter. The Republicans have done a good job of spreading the lies that things like medical insurance has risen because of law suits. The reason medical insurance has risen so fast is because the insurance companies have risen their rates so fast not because of lawsuits. Why the continuous jump in malpractice insurance when the lawsuits have decreased? The Republicans hate for lawsuits would cease if the would stop doing stuff where they have to have lawyers.

Look, I am not bashing the guy for being a lawyer. Those were JOKES, ok. I am concerned about what kind of lawyer he is. I don't support some of this stuff that calls itself "Tort Reform". A personal injury attorney would like my views on the issue- remember I am Constitution Party, not Republican.

I am not in favor of greatly limiting liability. The actual damages part needs to be high enough to be a deterent to companies who are tempted to release dangerous products. If the potential damage from lawsuits was forced too low, they could just write off killing people as a business expense!

Banks served as U.S. Attorney for the Eastern District of Arkansas. Mena is in far Western Arkansas. He had nothing to do with Mena. The U.S. Attorney for the West at that time was Michael Fitzhugh.

Seems like lots of pubbies were ready to believe it when the fingers were pointing to Clinton.

Plenty of room for all of us. Just because I make a post doesn't mean there is less electrons for you to use.

But I don't think that is what this is really about. There is some other reason you are trying to steer people away from this blog. Why don't you just be honest about it and tell us why?

I know of at least 10 people who were going to support Jim Holt until his supporters started trashing Chuck Banks and he did not condemn them for it. Jim Holt is losing votes right and left.

To anon 10:11

Number one, I flat think you are lying. You don't know 10 people who were going to support Holt "until his supporters started trashing Chuck Banks and he did not condemn them for it."

Number two, His supporters have not even been trashing Banks. The Arkansas Family Coalition Blog is not pro-Holt. That blog trashes all of the Lt. Gov candidates, including Senator Holt, except for Rick Calhoun. You can draw your own conclusions on that.

I am telling JOKES about lawyers in general. Telling lawyer jokes is not "trashing Banks". And saying I am concerned by the other blog's story that he is getting his money from fat-cat democrats is not "trashing" him either.

It is the famous Jean Duffy and Linda Ives that are accusing Banks of squelching the grand jury investigation. As far as I know they are not Holt supporters. I posted the link to THEIR CLAIMS. I reported it, the reader can draw their own conclusions.

Either give some details and real arguments or go away. Posting anonoymous hit and run lines is blog vandalism.
